Terms of Service

1. Acceptance of Terms

By accessing or using Καιρός ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

2. Account Registration & Security

Creating Your Account

To use Καιρός, you must create an account by providing accurate and complete information. You agree to:

• Provide truthful, accurate, and current information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Account Security

You are responsible for maintaining the confidentiality of your account credentials. We recommend using a strong, unique password and enabling biometric authentication if available on your device.

3. Service Description

Καιρός is a multi-modal journaling platform that combines physical NFC-enabled journals with AI-powered digital analysis. Our services include:

Core Features

• Journal Entry Processing: Upload photos of handwritten entries, record voice journals, or create visual artwork
• AI-Powered Analysis: Receive personalized insights, emotional pattern recognition, and reflective questions powered by Claude AI
• Guided Journey Paths: 56 structured journaling programs ranging from 7 to 100 days. 50 are included for everyone; the remaining 6 are grouped into themed packs sold as one-time purchases (see section 7)
• NFC Integration: Connect physical journals to your digital account via embedded NFC chips
• Progress Tracking: Monitor your journaling journey, streaks, and personal growth over time
• Export & Backup: Download your journal entries in portable formats

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

4. User Content & Ownership

Your Content

You retain full ownership of all journal entries, voice recordings, artwork, and other content you create using Καιρός. We do not claim any ownership rights to your personal content.

License to Operate

By uploading content to Καιρός, you grant us a limited license to:

• Store and backup your content on our secure servers
• Process your content through our AI analysis systems
• Display your content back to you within the application
• Generate insights and analytics based on your content

This license is solely for the purpose of providing and improving our services. We will never sell, share, or publicly display your personal journal content.

Content Deletion

You may delete individual entries or your entire account at any time. Deleted content is permanently removed from our active systems within 30 days and from backups within 90 days.

5. AI Services & Limitations

AI-Powered Features

Καιρός uses Anthropic's Claude AI to provide journal analysis and insights. By using these features, you understand that:

• AI analysis is meant to support self-reflection, not replace professional advice
• AI-generated insights are based on patterns and may not always be accurate
• Your journal content is processed by third-party AI services (Anthropic)
• AI responses may vary and are not deterministic

AI Availability

AI features depend on third-party services and may be temporarily unavailable. We do not guarantee continuous availability of AI analysis features.

6. Acceptable Use Policy

Permitted Uses

Καιρός is designed for personal journaling, self-reflection, and personal growth. You may use the Service for:

• Personal journaling and self-reflection
• Tracking personal growth and emotional patterns
• Following guided journey paths
• Storing and organizing your personal writings and artwork

7. Subscription & Payments

Free & Premium Tiers

Καιρός offers both free and premium subscription options:

Your journal is yours: writing, recording and re-reading entries are never limited. What the free plan meters is AI analysis, because each one has a real per-use cost. Transcribing a photographed page is not counted separately from the analysis it feeds. The allowance resets on the first of each calendar month (UTC) and unused analyses do not carry over.

Payment Terms

If you purchase a premium subscription:

• Subscriptions are billed in advance on a monthly or annual basis
• Your subscription will automatically renew unless cancelled
• You may cancel at any time; access continues until the end of the billing period
• Refunds are handled according to the app store's refund policies

Price Changes

We may change subscription prices with 30 days' notice. Price changes will not affect your current billing period.

Premium for the Life of the Service (Insight Collection)

The Insight collection includes Καιρός Premium without a subscription. The Essential and Legacy collections instead include Premium for a fixed period — three and twelve months respectively — after which the free plan's monthly allowance applies unless you subscribe. Because "lifetime" is often used loosely, here is exactly what we mean by it for Insight:

• Duration: Premium access for as long as we operate Καιρός. It is not tied to your lifetime, and it does not expire on a fixed date. If we cease operating the service, this access ends with it.
• No recurring charge: There is no renewal, no billing cycle, and nothing to cancel. You will never be charged again for Premium.
• Scope: It covers Premium as described at the time of your purchase, together with any later improvements to Premium. It does not automatically include separately sold products, add-on packs, or new offerings priced independently of Premium.
• Fair use: Premium is intended for personal journaling. We may apply reasonable limits to automated, bulk, or shared-account use that falls well outside normal individual use. We will contact you before applying any limit to your account.
• If we shut down: We will give you at least 90 days' notice and the ability to export your entries before the service ends.

One-Time Purchases (Path Packs)

Some journey paths are sold in themed packs for a single payment rather than through a subscription. At the time of writing these are the Kairos Collection and Starting Over, each €2.99 for all three paths it contains.

• What you get: Permanent access to every path in that pack, on any device you sign in to. There is no renewal, no billing cycle and nothing to cancel.
• Separate from Premium: A pack is not part of Καιρός Premium. Subscribing does not include it, and the Premium bundled with a journal does not include it. Equally, a pack does not expire when a subscription ends — it is yours either way.
• Availability: We may stop offering a pack for sale. If we do, you keep everything you already bought.

Right of Withdrawal (EU/EEA consumers)

You normally have 14 days to withdraw from a purchase of digital content without giving a reason. Because a path pack is unlocked for you immediately, that right ends once we begin supplying it — but only if you have agreed to that. At checkout you therefore expressly request immediate access and acknowledge that you lose your right of withdrawal once access has been granted.

If you would rather keep the full 14 days, do not complete the purchase. Write to us instead and we will arrange access at the end of the withdrawal period.

None of this affects your statutory rights if the content is faulty, is not as described, or does not work as it should. If a pack does not work for you, email legal@kairos-journal.com and we will refund it.

8. Physical Products (NFC Journals)

If you purchase physical Καιρός journals with NFC technology:

Product Terms

• Shipping: Delivery times and costs vary by location. We are not responsible for delays caused by shipping carriers or customs.
• Returns: Unused journals may be returned within 30 days for a full refund. Used journals cannot be returned.
• Warranty: Physical journals are warranted against manufacturing defects for 1 year from purchase.
• NFC Functionality: NFC chips are warranted to function for at least 5 years under normal use.

Journal Registration

Each physical journal contains a unique NFC identifier. By registering a journal to your account, you confirm that you are the legitimate owner or authorized user of that journal.

9. Intellectual Property

Our Property

Καιρός, including its name, logo, app design, journey content, prompts, and underlying technology, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Feedback

If you provide suggestions, ideas, or feedback about Καιρός, you grant us a perpetual, royalty-free license to use that feedback to improve our services without compensation to you.

10. Disclaimers & Limitations

Service Provided "As Is"

Καιρός is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Καιρός and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or content
• Loss of profits or revenue
• Emotional distress
• Service interruptions
• Errors in AI analysis or insights

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

Termination by You

You may delete your account at any time through the app settings. Upon deletion:

• Your access to the Service will end immediately
• Your personal data will be deleted within 30 days
• Backup copies will be deleted within 90 days
• Any active subscriptions will be cancelled (no refund for partial periods)

Termination by Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• Your use of the Service poses a security risk
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of Austria, without regard to conflict of law principles.

Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@kairos-journal.com and attempt to resolve the dispute informally for at least 30 days.

Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts in Vienna, Austria.

13. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Καιρός.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms. We may assign our rights to an affiliate or successor.
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
